By entering or using the Xpickle court and facilities (“Facility”), you agree to the following simple and clear Terms & Conditions. These rules are designed to protect you and to protect Xpickle.

1. Use at Your Own Risk

• Playing pickleball and using the Facility involves physical activity. Injuries such as slips, falls, strains, or collisions can happen.

• By using the Facility, you accept full responsibility for your own safety.

• You agree that you are using the Facility completely at your own risk.

2. No Liability from Xpickle

• Xpickle is not responsible for any injury, accident, or harm that may happen while you are on the premises.

• Xpickle is not responsible for loss, theft, or damage to your personal belongings.

• You agree that you will not hold Xpickle, its owners, or staff liable for anything that may happen to you or your property.

3. Indemnity

• You agree to indemnify and protect Xpickle from any claims, damages, or costs caused by:

  – Your use of the Facility

  – Your actions or negligence

  – Any injury or damage you cause to yourself, others, or the Facility

• This means you will not take legal action against Xpickle for anything that happens during your use.

4. Use of Xpickle Equipment (Paddles, Balls, Rentals, and Products)

• Any equipment provided, loaned, rented, or sold by Xpickle — including paddles, balls, training gear, accessories, or any other items — must be used responsibly and safely.

• You agree that you are fully responsible for any injury, accident, or damage resulting from your use or misuse of Xpickle equipment.

• Xpickle is not liable for any damage, breakage, or wear-and-tear that occurs while you use the equipment.

• In the event that rented or loaned equipment is lost, stolen, or damaged beyond normal use, you agree to compensate Xpickle for repair or replacement costs.

• By using Xpickle equipment, you accept all related risks and waive any liability claims toward Xpickle.

5. Health & Fitness

• You confirm that you are physically fit to play pickleball.

• If you have any medical conditions, it is your responsibility to get medical advice before playing.

6. Personal Belongings

• Keep your belongings with you. Xpickle is not responsible for any lost or stolen items.

7. Facility Rules

To keep everyone safe, you agree to:

• Wear proper footwear

• Use equipment responsibly

• Avoid dangerous behaviour

• Treat others with respect

• Follow all posted rules and instructions

Xpickle may ask anyone to leave the premises if rules are broken.

8. Photography

• Xpickle may take photos/videos of the Facility for promotional use.

• If you do not want to appear in any photos, please inform us.

9. Changes to These Terms

• Xpickle may update these Terms at any time. The latest version applies to all users.
